Privacy Policy (GDPR / CCPA)

VisualCraftEngine, registered at 12105 Ringstr. 75 Berlin, Germany (“VisualCraftEngine”, “we”, “us”), is the data controller for personal information collected through visualcraftengine.com and related communications. We process personal data in accordance with the EU General Data Protection Regulation (Regulation (EU) 2016/679) and the California Consumer Privacy Act (CCPA).

1.1 Categories of data we collect

Identity and contact data (full name, email address, phone number, company name), project information you voluntarily submit through our inquiry console, billing details required for invoices and payment processing, and technical data such as IP address, browser type, and pages visited (via essential and, where accepted, analytics cookies).

1.2 Purposes and legal bases

We process data to respond to inquiries and prepare quotes (Art. 6(1)(b) GDPR — pre-contractual measures), to perform design and development contracts (Art. 6(1)(b)), to satisfy accounting and tax obligations (Art. 6(1)(c)), to protect the security of our website (Art. 6(1)(f) — legitimate interests), and where you have given explicit consent for analytics or marketing (Art. 6(1)(a)).

1.3 Processors, transfers and retention

Data may be processed by vetted processors including our hosting provider, email service, Stripe for payments, and Google Maps for the embedded map on our contact page. Processors act only on our documented instructions. Where data is transferred outside the EEA, we rely on Standard Contractual Clauses or an adequacy decision. Inquiry records are retained for up to 24 months; financial records for 10 years as required by German commercial and tax law.

1.4 Your rights

Subject to statutory conditions, you have the right of access, rectification, erasure, restriction of processing, data portability, and to object to processing based on legitimate interests. You may withdraw consent at any time without affecting prior processing. You may also lodge a complaint with a supervisory authority (for Berlin: the Berliner Beauftragte für Datenschutz und Informationsfreiheit). CCPA consumers may request disclosure or deletion of personal information and may opt out of “sale” — we do not sell personal information.

To exercise any right, contact [email protected]. We respond within 30 days.

Section B

Terms of Service

These Terms govern engagements between you (“Client”) and VisualCraftEngine, 12105 Ringstr. 75 Berlin, Germany, for web design, interface design, and related digital services. By confirming a quote or Statement of Work (SOW), you accept these Terms.

2.1 Scope and statements of work

Each engagement is defined in a written SOW specifying deliverables, assumptions, timeline, and fixed price or rate card. Work outside the agreed scope requires a written change order. Prices are quoted in USD or EUR and exclude VAT where VAT applies; applicable VAT is shown on the invoice.

2.2 Payment terms

Unless the SOW states otherwise, engagements require a 50% deposit before work begins, with the balance due prior to final handover. Retainers are billed monthly in advance. Invoices are payable within 14 calendar days. Payment may be made via our Stripe payment link. Overdue balances may suspend active work after written notice.

2.3 Delivery, revisions and acceptance

Turnaround estimates start after receipt of deposit and all required Client materials. Each deliverable includes the revision rounds stated in the SOW. Client shall accept or provide consolidated written feedback within 7 business days of delivery; silence may be treated as acceptance. Delayed Client feedback extends the timeline day-for-day.

2.4 Intellectual property

Upon receipt of full payment, VisualCraftEngine assigns to the Client all rights in the final, client-specific deliverables. VisualCraftEngine retains ownership of pre-existing tools, frameworks, and internal libraries, and may showcase non-confidential work in its portfolio unless the SOW states otherwise. Client is responsible for supplying licensed content (fonts, imagery, trademarks) or instructing us to obtain licenses on its behalf.

2.5 Warranties and liability

We warrant that services will be performed with professional care. For 30 days after handover, we will fix demonstrated defects in our deliverables at no charge. Except as required by law, we are not liable for indirect or consequential damages. Our aggregate liability under any SOW is limited to the fees actually paid under that SOW. Nothing in these Terms limits liability for fraud, willful misconduct, or other liability that cannot be excluded under German law.

2.6 Term and termination

Either party may terminate an SOW for material breach if the breach remains uncured 14 days after written notice. Upon termination, Client pays for all work performed up to the termination date. Retainers may be cancelled with 30 days written notice at the end of the billing period.

Governing law: Federal Republic of Germany. Place of jurisdiction: Berlin, to the extent permitted by law. Contact for all contractual notices: [email protected].

Section C

Cookie Policy

VisualCraftEngine uses cookies and similar technologies on visualcraftengine.com. Under the ePrivacy Directive and GDPR, strictly necessary cookies may be placed without consent; all other cookies require your opt-in via our cookie banner, which stores your choice in your browser’s localStorage.

3.1 Categories of cookies

Strictly necessary: session integrity, security, load balancing, and remembering your cookie consent choice. These cannot be switched off through our banner.

Analytics (optional): aggregated statistics about page views, referrers, and device types so we can improve layout clarity. Set only after you accept the banner.

Functional (optional): preferences such as remembered form drafts or region, improving convenience on repeat visits.

Third-party embeds: our contact page embeds Google Maps. Loading the map may cause Google to set cookies under Google’s own policies. You can avoid this by not interacting with the map or by using browser settings to block third-party cookies.

3.2 Managing cookies

You can clear stored consent by deleting site data in your browser settings; the banner will reappear on your next visit. Most browsers also allow you to block or delete cookies entirely, though blocking strictly necessary cookies may degrade site functionality. For CCPA purposes, we do not share personal information for cross-context behavioral advertising without consent where required.

Section D

Refund Policy

VisualCraftEngine sells time-bound, customized design services. The following policy applies to all invoices and Stripe payment link transactions, without prejudice to mandatory consumer rights under EU law.

4.1 Deposits before work begins

If you cancel in writing before any design or development work has started, your deposit is refunded in full within 10 business days to the original payment method.

4.2 Work in progress

Once work has commenced, the deposit is non-refundable as it reserves studio capacity. If you terminate mid-project, you receive all work completed to date, and any prepaid unused portion for undelivered milestones is refunded proportionally within 14 business days.

4.3 Completed milestones and retainers

Delivered and accepted milestones are non-refundable. Monthly care retainers may be cancelled for the next billing cycle with 30 days written notice; the current paid period is not refunded once the period has begun, except where we fail to deliver the retainer’s minimum response commitments for a full month.

4.4 Defects and re-performance

If a deliverable materially deviates from the agreed SOW, notify us within 14 days of delivery. We will re-perform the non-conforming work at no cost within a reasonable time. Persistent non-conformance that we cannot cure entitles you to a fair price reduction for the affected deliverable.

4.5 How to request a refund

Email [email protected] with your invoice number, project name, and reason for the request. We acknowledge requests within 2 business days and resolve approved refunds within 10 business days. Refunds are issued to the original payment method.
